The Internet Corporation for Assigned Names and Numbers (ICANN) has published an Advisory on the impact of China's Personal Information Protection Law (PIPL) on complaints pertaining to third-party access to nonpublic generic top-level domain (gTLD) registration data.
The ICANN organization alerted the community to the implementation of the PIPL in a 21 October 2021 blog, and the law went into effect on 1 November 2021. ICANN Contractual Compliance has begun receiving complaints concerning instances in which registrars are asserting the PIPL as a basis for denying requests from third parties for access to nonpublic gTLD registration data.
The newly published Advisory clarifies how ICANN Contractual Compliance approaches enforcement of contractual obligations that are impacted by local law and explains how PIPL may impact requirements relating to the disclosure of nonpublic registration data.
